Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Timents ("Timents", "we", "us") and govern your access to and use of the Timents iPhone app, the website at timents.com, public-safe web preview pages, and related features (together, the "Service"). These Terms also serve as the End User License Agreement ("EULA") for the Timents app.

Timents is a date-anchored, private-first memory app: you revisit the same calendar day across the years of your life, alongside the people who were part of it. Please read these Terms carefully. By using the Service you agree to them and to our Privacy Policy. If you do not agree, do not use the Service.

Effective date: June 12, 2026.

1. Acceptance of these Terms

By creating an account, joining the waitlist, redeeming an invite code, installing the app through Apple TestFlight or the App Store, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference.

These Terms also include, by reference, our Community Guidelines and the Apple-required terms in the Third-party services and Apple EULA terms section below. Where there is a direct conflict between these Terms and the Apple-required terms as they apply to your use of the app obtained from Apple, the Apple-required terms control for that purpose.

If you use the Service on behalf of another person or an organization, you represent that you are authorized to accept these Terms on their behalf.

2. Who can use Timents

To use Timents you must:

  • Be at least 13 years old. Timents is not intended for children under 13. Date of birth is collected and access is age-gated. Where local law sets a higher age of digital consent, that higher age applies to you.
  • Not be barred from using the Service under the laws of your country or any applicable sanctions or export-control rules (see the Apple EULA terms).
  • Have valid access. The Service is currently in a private beta and access is gated by a waitlist (email capture) and invitation codes. An invite or waitlist position does not guarantee continued or permanent access.

One account. Timents is meant to be a personal record of your life, so you should maintain a single account tied to your own identity. Do not impersonate others or create accounts to evade blocks, suspensions, or other enforcement. We may limit or remove duplicate or deceptive accounts.

3. Beta and pre-release nature

Timents is currently distributed as a private beta through Apple TestFlight and is a pre-release product. This means:

  • The Service is provided on an "as is" and "as available" basis and is still under active development.
  • Features, interfaces, audiences, chapters, the memories calendar, web previews, and account flows may change, be added, be removed, or break without notice.
  • We do not guarantee uptime, availability, error-free operation, or that any specific feature will continue to exist.
  • We do not guarantee data persistence during the beta. Moments, captions, chapters, and other content created during beta testing may be reset, migrated, or lost, including between builds. Please keep your own copies of anything you would be sad to lose. Your original photos remain in your own device library unless you delete them yourself.

Feedback license. If you send us feedback, bug reports, ideas, or suggestions about the beta or the Service, you grant Timents a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose, without obligation or compensation to you. You are not required to provide feedback, and you should not include confidential information in it.

TestFlight is operated by Apple and is subject to Apple's own terms. You can join the current beta at our TestFlight link.

4. Your account and verification

Timents uses passwordless sign-in. You sign in with your email address or phone number using a 6-digit one-time verification code. There are no passwords, and Timents does not currently offer third-party single sign-on (such as Sign in with Apple or Google).

Because access depends on those codes and your signed-in device, you agree to:

  • Keep your device secure and protect your verification codes. Anyone with access to your code or your signed-in device may be able to access your account.
  • Provide accurate account and profile information, including a date of birth for age-gating.
  • Take responsibility for activity that occurs under your account, except to the extent it results from our own breach of these Terms.
  • Tell us promptly at support@timents.com if you believe your account has been accessed without your permission.

Certain sensitive actions, such as account deletion, may require recent re-verification before they are confirmed.

5. Your content and the license you grant us

You own your content. You keep all rights you already have in the moments, captions, comments, reactions, chapters, profile details, and other material you create or upload ("User Content"). Timents does not claim ownership of your User Content.

The license you grant us. To run the Service for you, you grant Timents a limited, non-exclusive, worldwide, royalty-free license to host, store, back up, reproduce, process, adapt for technical purposes (such as resizing or creating public-safe media variants), transmit, and display your User Content — solely to operate and provide the Service in line with the audience you choose for each moment or chapter. This license exists so that, for example, we can deliver a moment to the friends you selected, render a chapter for its members, or store your private moments so only you can see them.

  • A moment is a photo and caption anchored to a specific calendar date, with a chosen audience: Only you, Friends, Chapter (members), or Everyone (public).
  • A chapter is a shared space for moments that belong together, and can be members-only or public.
  • If you choose an Everyone (public) audience, that content may appear on intentionally minimal, public-safe web preview pages (such as /u profiles, /m moments, and /c chapters) and may be viewable more broadly within the Service.
  • Content limited to Only you, Friends, or a Chapter (members) audience is not served as a permanent public URL.

The license ends when you delete the relevant User Content or your account, except that copies may persist for a limited period in encrypted backups or security logs where required for integrity, fraud prevention, or legal reasons, and except for content that others have already separately saved or that you shared publicly. No system can guarantee absolute secrecy once content is shared with others who can access it.

Your representations. You represent that you have the rights needed to upload and share your User Content and that it does not infringe or violate anyone else's rights, including privacy, publicity, intellectual property, or contractual rights, and that it complies with our Community Guidelines.

6. Acceptable use and prohibited conduct

Timents is built to be calm and human. It is deliberately not an infinite feed, not an entertainment loop, not a comparison engine, and has no popularity counters. Please use it accordingly. You agree not to:

  • Break the law or infringe anyone's rights.
  • Harass, threaten, stalk, impersonate, exploit, or endanger other people.
  • Upload content that is illegal, abusive, or that sexually exploits or endangers minors.
  • Upload malware, attempt unauthorized access, scrape the Service, probe its security, or interfere with its operation or infrastructure.
  • Share content you do not have permission to use or distribute.
  • Misuse invitation codes, waitlist access, notifications, or other features, or attempt to manipulate access or visibility.
  • Use the Service to build a competing dataset or to reverse engineer it, except where that restriction is prohibited by law.

7. Content moderation, reporting, and enforcement

You can manage your own experience and help keep Timents safe using in-app tools, including per-moment audience controls, Block, Mute, and Report for content or users.

When content or behavior is reported to us or otherwise comes to our attention, we may, where we reasonably believe it is appropriate or legally required, remove or restrict content, limit features, or suspend or terminate accounts. We aim to act proportionately, but we may act quickly to address safety, legal, or integrity risks. To protect everyone's privacy, when content cannot be shown the Service's response stays generic on purpose and does not explain why.

You can report content or users from inside the app, or contact our safety team at safety@timents.com. Enforcement standards are described in our Community Guidelines.

8. Privacy

Your privacy is central to how Timents is built. Our Privacy Policy explains what we collect, how we use it, and the choices you have. In short: Timents does not track you as defined by Apple's App Tracking Transparency framework, does not run third-party advertising, and does not sell personal information. Analytics are first-party and used only to operate and improve the Service.

A plain-English map of your controls is available on Privacy Choices. By using the Service, you also agree to the practices described in the Privacy Policy.

9. Intellectual property

The Service itself — including the Timents app, the "Timents" name and the tagline "Your life, on this day.", logos, design, user interface, editorial "On this day in history" World Day cards, text, graphics, and underlying software — is owned by Timents or its licensors and is protected by intellectual property and other laws. World Day cards are curated by Timents and carry no engagement affordances.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the app on Apple-branded devices you own or control, solely for your own personal, non-commercial use. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of the Service, or reverse engineer or attempt to extract its source code, except to the extent that restriction is prohibited by applicable law. All rights not expressly granted are reserved.

You may not use the Timents name, logos, or branding without our prior written permission, except as needed to refer to the Service accurately.

10. Feedback

We welcome your thoughts. As described in the beta section, any feedback, suggestions, or ideas you choose to share with us may be used by Timents freely and without restriction or compensation. Sending feedback does not give you any ownership interest in the Service or any improvements made to it.

11. Third-party services and Apple EULA terms

The Service relies on third-party providers, including the following subprocessors:

  • Apple — app distribution via TestFlight and the App Store, and the Apple Push Notification service.
  • Google Firebase — authentication, Firestore database, Cloud Storage for media, Remote Config, and Cloud Messaging (push).
  • Google Cloud Platform — hosting and a Cloud Run service that renders public-safe web preview pages (/u, /m, /c, /invite).
  • Email and SMS delivery providers — sending one-time verification codes and account messages.

These providers operate under their own terms and policies, which may apply to your use of the Service. Timents is not responsible for third-party services it does not control.

Apple-required EULA terms

Because the Timents app is distributed through Apple, the following terms apply to your use of the app obtained from the App Store or TestFlight. Where these terms conflict with the rest of these Terms as applied to the Apple-sourced app, these Apple terms govern:

  • This agreement is between you and Timents only, not Apple. Apple is not a party to these Terms and is not responsible for the app or its content.
  • Scope of license. The license granted to you for the app is a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing where applicable.
  • Maintenance and support. Timents, not Apple, is solely responsible for providing any maintenance and support services for the app. Apple has no obligation to furnish any maintenance or support services.
  • Warranty. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the app. Apple has no other warranty obligation whatsoever regarding the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Timents' responsibility.
  • Product claims. Timents, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation, to the extent permitted by law.
  • Intellectual property claims. In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, Timents, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with applicable third-party terms when using the app, and with all applicable U.S. and other export and sanctions laws.
  • Apple as third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • Developer contact. Questions, complaints, or claims about the app should be directed to Timents at support@timents.com.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory. Timents and its suppliers disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting that, and especially given the beta nature of the Service, we do not warrant that the Service will be uninterrupted, secure, error-free, or permanently available; that any content or data will be preserved or recoverable; or that defects will be corrected. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Timents and its affiliates, founders, employees, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, data, content, goodwill, or business interruption, arising out of or relating to your use of (or inability to use) the Service — including any loss of moments or other content during the beta — even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, the total aggregate liability of Timents arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total amounts you paid to Timents for the Service in the twelve months before the claim, or (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you, in which case our liability will be limited to the minimum extent permitted by law.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Timents and its affiliates, founders, employees, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use or misuse of the Service; (c) your violation of these Terms, including the Community Guidelines; or (d) your violation of any law or the rights of any third party. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.

15. Termination and account deletion

You may stop using the Service at any time. You can delete your account from the authenticated account and settings surface in the app. The deletion flow asks you to request deletion and confirm with recent verification; Timents then disables the account, revokes active sessions, and starts privacy purge work. Limited copies may remain in encrypted backups or security logs for a short period where required for integrity, fraud prevention, or legal reasons. We may suspend, restrict, or terminate your access if we reasonably believe you have violated these Terms or our Community Guidelines, created risk or legal exposure for users or Timents, or where required by law. We may also discontinue the Service, in whole or in part, particularly given its beta status. Sections that by their nature should survive termination — including content licenses you have granted, feedback, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

16. Changes to the Service or these Terms

Because Timents is in active development, we may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will revise the effective date above and provide additional notice where appropriate. Changes take effect when posted unless we say otherwise. If you continue to use the Service after updated Terms take effect, you accept the updated Terms. If you do not agree, please stop using the Service and delete your account.

17. Governing law and dispute resolution

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.

Before filing any formal claim, please contact us at legal@timents.com so we can try to resolve the matter informally; we ask that you give us at least 30 days to do so. Subject to applicable law, you and Timents agree to submit to the personal jurisdiction of the courts located in Vancouver, British Columbia, Canada for the resolution of any disputes that are not resolved informally. Nothing in these Terms limits any rights you may have under the mandatory laws of your country of residence that cannot be waived by agreement.

18. Severability, entire agreement, and assignment

Severability. If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.

Entire agreement. These Terms, together with the Privacy Policy, the Community Guidelines, and the Apple-required EULA terms above, are the entire agreement between you and Timents regarding the Service and supersede any prior agreements on that subject.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, financing, or sale of assets, or by operation of law.
